The following Terms of Service (the “Terms”) set forth the agreement between you and Barclay-Lethbridge dba Scriptographer (“Scriptographer”, “Scriptwriter”, “we”, “us”, or “our”). Please read these Terms carefully as they set out the basis for which Scriptographer makes our Services (as defined below) available to you. These Terms govern your use of Scriptographer websites, mobile applications, products, services, and all related documentation, tools and utilities (collectively, the “Services”).
In these Terms, “you” refers to the individual using the Services or, if applicable, the company or school you are using the Services on behalf of.

Our Services are provided without warranty and with limited liability on our part (see Sections 9 and 10 below).
1. Eligible Users
If you are under age 18, your use of the Services must be in compliance with your state’s or country’s rules regarding a minor’s access to the internet.
You are required to use a desktop or tablet device to use the Services. You are responsible for maintaining the confidentiality of your information and scripts. You agree to accept all responsibility for all activity and actions done on your devices. You may stop using the Services at any time but you will be responsible for removing any downloaded files yourself.
You may not edit anyone else’s works without their express permission.
2. Changes
We reserve the right to change or discontinue the Services at any time and in any way. We may assess, upgrade, or change the version of any software you are using and, in order to continue to use the Services, you may be required to use these updated Services.
3. Acceptable Use
You must use the Services responsibly and not misuse the Services. For example, you must not (yourself or through a third party):
(a) use the Services to harm, threaten, or harass anyone;
(b) use the Services and/or the non-public information you gain from using the Services to create similar services;
(c) modify, alter, tamper with, repair or otherwise create derivative works of any of our proprietary software; reverse engineer, disassemble, decompile, discover, recreate or create derivative works of any of our proprietary software (excluding open source code) used to provide or access the Service;
(d) use any Artificial Intelligence (AI) to write content;
(e) use the Services in any manner or for any purpose other than as expressly permitted by these Terms, the Licenses and the information available on our websites;
(f) sell, lend, rent, lease, sublicense, assign or otherwise transfer any of the rights granted to you with respect to the Services to any third party;
(g) remove, obscure or alter any proprietary rights notice pertaining to the Service, including notices on any of our software, apps, or documentation;
(h) access or use the Services in a way intended to avoid incurring fees or exceeding usage limits or quotas;
(i) use the Services in connection with anything misleading or illegal or post anything that, in the sole discretion of Scriptographer, is believed or deemed to be unlawful, defamatory, threatening, pornographic, abusive, libelous or otherwise objectionable or that encourages criminal conduct;
(j) attempt to access other computer systems or networks not covered by these Terms, through malware or any other means;
(k) share or generate content publicly or otherwise engage in behavior that violates anyone’s Intellectual Property Rights. “Intellectual Property Rights” means copyright, moral rights, trademark, trade dress, patent, trade secret, unfair competition, right of privacy, right of publicity, and any other proprietary rights;
(m) share or generate any content that sexualizes minors or that is intended to facilitate inappropriate interactions with minors, other users, or the public;
(n) upload, transmit, store, or make available any content or code that contains any viruses, malicious code, malware, or any components designed to harm or limit the functionality of the Services;

(p) violate any applicable laws or regulations; or
4. Suspension or Termination of Your Access
We reserve the right to suspend or terminate your access to the Services if we know or have reason to believe that you have violated these Terms or a License or materially disrupt others’ use of the Services. We may do so with or without notice and without liability to us.
5. Your Content
The Services may allow you to create, upload, store, share, or otherwise make content available. You are solely responsible for the content you submit through the Services, including its legality, reliability, and appropriateness. Such content may be scanned for any form of virus, Trojan horse, worm or other software routines that may (a) permit unauthorized access or (b) disable, erase or otherwise harm software, hardware or data.
By uploading content, you represent and warrant that:
Storage: It is a best practice to regularly back up your content to another location, even if the Services provide storage and storage is enabled for the applicable Services. We may impose reasonable technical limits, including limits on file size, storage capacity, processing capacity, and other system attributes. If you exceed the storage limit associated with your account, the Service may cease to function properly.
6. Ownership
Scriptographer and its licensors retain all right, title, and interest in the Services, trademarks, servicemarks, and logos, including all underlying software, technology, and processes, along with any enhancements or modifications.
Original works written on Scriptographer are the sole intellectual property and copyright of their original author(s) and Scriptographer makes no stakes or claims to these works.

7. Feedback
We may use your feedback and suggestions for any purpose without attribution, accounting, or compensation to you.
8. Privacy
When you use the Services, you and we are subject to our Privacy Policy (https://scriptographer.pages.dev/docs/info/privacy). Please review our Privacy Policy carefully as it explains what information we collect from you.
9. NO WARRANTY
THE COVERED SOFTWARE IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES THAT THE COVERED SOFTWARE IS FREE OF DEFECTS, MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE, OR NON-INFRINGING.
10. LIMITATION OF LIABILITY
IN NO EVENT SHALL ANY CONTRIBUTOR BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THIS LICENSE OR THE USE OF THE COVERED SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
